Local Rules History

The Court has prepared several changes to its Local Bankruptcy Rules. These changes are being published now for comment and will be accepting comments on these proposed changes through Friday, January 4, 2013. Here is a memo from the Clerk with more information. LBR 4007-1 - Dischargeability Complaints If additional creditors are added by amendment after the filing of the case but prior to the date set to file a complaint to determine the dischargeability of a debt under Section 523(c), the court shall deem such amendment as a request to extend the time to file such complaint until the latter of the original bar date or thirty (30) days from the date of service of the amendment upon the added creditors. The request to extend shall be deemed granted by the court. Amendment to LBR 2002-1(a)

The United States Bankruptcy Court for the Middle District of Georgia has proposed amendments to the court's Local Rules which are available for comment. A copy of the changes can be reviewed or printed below. Comments must be sent to the Clerk of Court no later than August 31, 2011.

The Local Bankruptcy Rules for the Middle District of Georgia have undergone a thorough revision and as such, the body of rules are being readopted in their entirety by the court effective May 3, 2010. The local rules for the United States Bankruptcy Court, Middle District of Georgia, have undergone complete review. All of the rules are offered for comment, and all rules are hereby republished for purposes of future adoption as the permanent local rules for the court. The following rules have had the most substantive additions or deletions: LBR 1007-1, LBR 2016-1, LBR 3007-1, LBR 3012-1, LBR 3022-1, LBR 4001-1, LBR 4008-1, LBR 9004-1, LBR 9013-3. January 5, 2005 | On December 11, 2003, the court abrogated Local Bankruptcy Rule 9010-1. This rule governed the procedure to be followed for attorneys wishing to appear in the Bankruptcy Court Pro Hac Vice. The reason for the rule abrogation was based upon a conflict with the local rules for the United States District Court. Attorneys are advised to refer to the United States District Court Local Rule 83.1.2 regarding a request to practice in a particular case. The rules regarding bar admission and authority to practice in the Bankruptcy Court for the Middle District of Georgia are governed by the admission rules for the United States District Court. Any questions concerning this procedure should be directed to the Clerk of the District Court or the Clerk of the Bankruptcy Court. | |

The text of rule LBR 90014.1 was incorrectly located in the previous release of the rules. That formatting error has now been corrected. The following rules of the United States Bankruptcy Court for the Middle District of Georgia are hereby amended effective September 2, 2002: LBR 1015-1, LBR 2002-1, LBR 9004-1, LBR 9010-1, LBR 1019-1, LBR 3015-3, LBR 9007-1 The rules of the United States Bankruptcy Court for the Middle District of Georgia are further amended by adding LBR 9014-1. |
